Swallows-Gallants saga deepens as legal battle intensifies

The move signals Gallants’ intention to vigorously contest Swallows’ attempt to terminate the sale of their Betway Premiership status, which was concluded in May 2024 for a fee of R40 million.

Swallows have accused the Bloemfontein-based outfit of defaulting on the terms of the contract by failing to settle the full purchase price as agreed in writing. 

The payment structure included R20 million upfront, which was paid in sporadic amounts, and a further R10 million earmarked for staff as well as player contract settlements due if employment is terminated. 

What remains unpaid is the Swallows’ tax liabilities with SARS, which has since ballooned to approximately R13 million due to penalties and interest.

Following the delivery of legal documents requesting the formal cancellation of the agreement, Gallants responded by filing a notice to oppose, granting them up to 15 days to submit their case. 

Sources suggest the club believes it has sufficient grounds to argue that it has substantially honoured the agreement, although other insiders view the move as a strategic attempt to delay proceedings until the end of the season.

Swallows, however, are pushing for a full termination of the agreement, arguing persistent non-compliance.

The Premier Soccer League is monitoring the situation closely but remains at arm’s length while the matter unfolds in court.

The sheriff of the court has also formally served both the PSL and the South African Football Association with legal notice of Swallows’ intent to cancel the transaction.

Should the court grant the relief sought, Swallows would regain full control of their top-flight status and could pursue alternative buyers. 

The most straightforward resolution would see Gallants settle the outstanding R13 million, effectively bringing the dispute to an end but it’s believed the matter is far more complex and could drag on for months.
